ADOPTION AGREEMENT
The Klamath Humane Socie= ty (KHS) reserves the right to refuse adoption of any Horse/Mule/Donkey/Sheep (Large Animal) to any adopter if we feel that the adopter and Large Animal is not a good match. All adopted Large Animals must be well taken care of. This means that it must be well treated, provided adequate shelter and proper feed and= an unlimited supply of water. The adopter must agree that no backbone or ribs = will show at anytime and he shall keep the Large Animal in good health and provi= de medical attention when needed, i.e., lame or sick. Adopter must worm and gi= ve vaccines on a regular basis. Hooves will also be trimmed as needed.
Adopter must never place= the Large Animal with an abusive trainer and shall make sure that all contact with hu= mans and animals shall be free from abuse and neglect. The adopter certifies that he/she has no prior animal convictions of inhumane treatment or abuse. Adopter agrees to allow the KHS to monitor the well-being of the Large Animal and if found that the Large Anim= al is not cared for properly, the KHS has the right to repossess the Large Ani= mal at the time of inspection and the adopter agrees to pay all recovering costs and attorney fees, if such an action is required.
The adopter agrees not t= o sell, trade, auction, give away, lease, or use for any commercial purpose other than showing. If adopter is unable to care for the Large Animal for any reason, = it must be returned to the KHS.
Adopter MUST notify The = Klamath Humane Society in writing if any of the following occurs:
1. Death of the Large An= imal. Notification is required with a statement from the veterinarian giving the cause of death.
2. If the Large Animal i= s to be moved from the location other than that on the application, KHS must be notified immediately.
3. Change of address or = phone number of the adopter
4. Sever illness of the = Large Animal
5. If the adopter is no = longer able to care for the Large Animal for any reason.
All adopters of horses/mules/donkey= s will pay an adoption donation. All donations will go to the large animal fund for the continued care and rescue of other horses/mules/donkeys. There will be = no reimbursements from KHS for any reason. Payments will be made by cash, cashier’s check or money order. All adoption fees are non-refundable.=
Adopter agrees to abide = by all the above conditions. If KHS finds that any of the conditions have not been upheld, KHS has the right to remove and take possession of the adopted Large Animal by breach of contract.

ACCEPTANCE:
1. Adopter accepts Equine
“AS IS”, and KHS does not represent that
Equine is
anything other than what is visible.
2. Adopter agrees that Eq=

shall be for adopter’s personal use and

Shall be maintained by the adopter for the life =
of the
animal.
4. Adopter agrees that Eq=
uine
shall not be sold, traded, auctioned, or given away, leased or used for any
commercial purpose other than showing.
5. Adopter agrees to noti=
fy KHS
in the event Equine requires humane euthanasia
COSTS
1. If Equine is registere=
d with
a recognized breed association (or eligible therefore and Adopter desires to
affect any such transfer or registration, then any fees or penalties as may=
be
required or assessed by such a breed registry shall be at the full and sole=
expense
of the Adopter. All registrat=
ion
documents, applications, or certificates concerning Equine shall be the full
and sole responsibility of Adopter.
TERMS
AND TERMINATION:
1. This agreement shall b=
e effective
from the date hereinabove written and shall run until the earlier of (1) its
termination by KHS in accordance with the terms and conditions of this
agreement; or (2) at any time from the date of adoption of equine appears t=
o be
lacking the basic good care or environment as would normally be required by
Equine, upon which KHS shall take possession of Equine, if necessary; or (3)
following the death of Equine.
DISCLOSEURE
AND RIGHT OF INSPECTION:
1.<= span style=3D'mso-spacerun:yes'> Adopter agrees t= o at all times to disclose the primary physical address of where Equine is to be quarte= red, and to notify KHS by written notice when such primary location is changed.<= /p>
ASS= UMPTION OF LIABILITY:
1= . Adopter shall assume all liability and responsibility for Equine from the effective date of this agreement, and agrees that by accepting Equine, to assume full liability and responsibility for any injury or expense that may be occasion= ed by any person or animal, or any damage to any property by Equine, and shall fully indemnify and hold harmless the KHS, or its employees, agents and representatives, individually and collectively, from and against all claims, demands, causes of action, costs, charges and expenses of every kind and nature.
